We at Boschung (Boschung Mecatronic AG and its affiliates) are committed to protecting your privacy. This Privacy Policy applies to all the products, services, websites, apps and hardware products offered by Boschung in relation to the bMoves Services as defined in our Terms of Service. We refer to those products, services, websites and apps collectively as the “Services” in this policy.

References to your "data" in this Privacy Policy will refer to whatever data or content you use in our Services to collect, process or manage, including data inserted on one of our apps, data collected in a form, data inserted on a site hosted by us, GPS coordinates, or vehicles’ data. Unless for the cases expressly stated in this Privacy Policy or our Terms of Service, we do not use your data.

Reference to “personal information” or just “information”, means information about you personally that we collect or for which we act as custodian (e.g., email, organization and name).

To better understand what information is most relevant to you, see the following useful definitions.

Customer

You are the person or entity using and subscribing to bMoves Services (either Free Services Subscription or Paid Services Subscription), as defined by our Terms of Service.

User

You are authorized by a Customer to use bMoves Services on the Customer behalf and have a unique user identifications and passwords for the Services. You are creating, modifying, deleting, generating, reviewing, or working on data as defined under Section 1.  

Website Visitors

You are visiting one of our Websites. You may be interacting with our Websites. You may contact us and may send us relevant contact information.

3.1. Data we collect

Through the use of the Services, a User can collect data of several types. We collect those data only at the instigation of the User. Data can be of several types:

Master Data

Master Data are created by you through your use of our Services. They represent data that provide context and templates to the User when creating or reviewing Intervention Data

Intervention Data

Intervention Data are created by you through your use of our Services. They represent data that you choose to document, save or insert through your use of the Services.

Audio Data

Audio Data are created by you through your use of our Services. They represent audio notes that you choose to document in our Services.

Photo or Video Data

Photo or Video Data are created by you through your use of our Services. They represent photo or video notes that you choose to document in our Services.

Location

When you created Intervention Data with our Services, we might enrich them with a location providing details about where Intervention Data were generated. We are collecting the location only when you give us the permission and you enable the setting. The location is collected both when the app is in background and foreground.

Time

When you created data, we will enrich them with a time providing details about when Intervention Data were generated.

3.2. How we use the data

We use the data, according to the license you grant us in our Terms, only for the limited purpose of providing or improving the Services.

4.1. Information we collect about you

Contact Information (for example name or email address).
For Customer, User and Website Visitors

You might provide us with your contact information, whether through use of our Services, a form on our Website, or an interaction with one of our customer relationship teams.

Usage
For Customer, User, Website Visitors

We collect usage information about your interaction with our Websites and Services. This includes which webpages you visit, what you click on, when you perform those actions, what language preference you have, what you buy and so on.

Browser and device information
For Customer, User, Website Visitors

We collect information from the device and application you use to access our Services. Device information mainly means your IP address, operating system version, device type, device ID/MAC address, UUID, system and performance information, and browser type.

Information from page tags
For Customer, User, Website Visitors

We use first party and third party cookies and tracking services that employ cookies and page tags (also known as web beacons) to collect information about visitors to our Websites. This information includes usage and user statistics. Emails sent by Boschung also include page tags that allow the sender to collect information about who opened those emails and clicked on links in them. We provide more information on cookies below and in our Cookies Policy.

Log information
For Customer, User, Website Visitors

Like most Websites today, our web servers keep log files that record information each time a device accesses those servers. The log files contain information about the nature of each access, including originating IP addresses, internet service providers, the files viewed on our site (e.g., HTML pages, graphics), operating system versions, device type and timestamps.

Referral information
For Customer, User, Website Visitors

If you arrive at our Websites from an external source (such as a link on another website or in an email), we record information about the source that referred you to us.

Third party
For Customer, User, Website Visitors

We only collect information from third parties when information are publicly available or those are shared with us.

Profile information
For Customer, User

You need a bMoves account before you can use our Services. When you register for an account, we collect information about you. When you update your profile or your organization, we collect information about you.

Billing information
For Customer

If you make a payment to us, we require you to provide your billing details corresponding to your selected method of payment. We will use your billing details to determine appropriate sales taxes. If you pay by credit card, your credit cards information are processed and managed by our trusted third parties.

Account settings
For Customer, User

We collect the diverse information you entered in your settings (e.g., opting-in or opting-out of marketing communication).

Created accounts information
For Customer, User

We do not use information you used to create a new account in your organization until the user expressly accepted the applicable terms and policy apart for sending invitational emails.

4.2. How we use the information we collect

Until you allow us, we do not use your personal information or data. Prior to this, we only use your personal information anonymously and as part of a group of data (e.g. analytics of our Websites).

We are committed to the privacy and the security of your personal information and data. Boschung and its partner follow the strictest state-of-the-art security standard.

Please refer to the Section “Your Rights” to see what you can do with your personal information and data and how to do it.

Compliance with our Privacy Policy and the Law. We use the information we collect only in compliance with this Privacy Policy and the law. Customers who subscribe to our Services are obligated through our agreements with them to comply with this Privacy Policy.

Use of Personal Information. In addition to the uses identified elsewhere in this Privacy Policy, we may use your Personal Information to improve your browsing experience by personalizing the Websites and to improve the Services, to send information or Boschung content to you which we think may be of interest to you by post, email, or other means and send you marketing communications relating to our business, to promote use of our Services to you and share promotional and informational content with you in accordance with your communication preferences, to provide statistical information about our users – but this information will not be used to identify any individual user, to send information to you regarding changes to our Customer Terms of Service, Privacy Policy (including the Cookie Policy), or other legal agreements, and to meet legal requirements.

Use of Navigational Information. We use Navigational Information to operate and improve the Websites. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information about Boschung.

Use of Payment Information. If you give us Payment information, we use it solely to check your financial qualifications and collect payment from you. We use a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use information you provide except for the sole purpose of credit card processing on our behalf.

Security of your Personal Information and Data. We use a variety of security technologies and procedures to help protect your personal information and data from unauthorized access, use or disclosure. We secure the personal information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure.

Social Media Features. Our Websites include Social Media Features such as share buttons. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Websites. This Privacy Policy does not apply to these features.  Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.

External Websites. Our Websites provide links to other websites. We do not control, and are not responsible for, the content or practices of these other websites. Our provision of such links does not constitute our endorsement of these other websites, their content, their owners, or their practices. This Privacy Policy does not apply to these other websites, which are subject to any privacy and other policies they may have.

Public Forums. We offer publicly accessible message boards, blogs, and community forums. Please keep in mind that if you directly disclose any information through our public message boards, blogs, or forums, this information may be collected and used by others. We will correct, hide or delete any public content breaking our “Acceptable Use” as described by our “Terms of Service”.

Statistics. We may use your data and information to create statistics or surveys, to use machine learning or report about the usage of our Services. In such a case, your information and data will be anonymized and will not be identifiable.

Retention of Personal Information. How long we keep information we collect about you depends on the type of information. After such time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible. We retain Personal Information that you provide to us where we have an ongoing legitimate business need to do so (for example, as needed to comply with our legal obligations, resolve disputes or enforce our agreements). When we have no ongoing legitimate business need to process your Personal Information, we securely delete the information or anonymize it or, if this is not possible, securely store your Personal Information and isolate it from any further processing until deletion is possible. We will delete this information at an earlier date upon your request, as described in the “Your Rights” Section below.

If you have decided to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our content, products, or services, such as when you last opened an email from us or ceased using your Boschung account. 

We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created. The data our customers collect by using the Services is retained according to the relevant agreements with our customers.

4.3. Information we share

We never sell personal information or data. We do not share information or data with third parties outside of Boschung except for the following:

• Your administrator(s) will be able to view your account data and information, manage your account data, suspend, transfer or terminate your account or restrict your settings. Please refer to your organization’s internal policies if you have questions about this. We are not responsible for your organization’s usage of the Services or the internal policies applied by it.
• To help us provide certain aspects of our Services we use our affiliates and trusted key partners – to deliver and track our content, manage our sales and customer support, facilitate payments. We enter into confidentiality and data processing terms with partners to ensure they comply with high levels of confidentiality and best practice in privacy and security standards and we regularly review these standards and practices.
• We also may have to share information or data in order to, meet any applicable law, regulation, to enforce and investigate policy and terms violation, to recover overdue payments, to detect, prevent, or otherwise address fraud, security or technical issues, or to protect against harm to the rights, property or safety of our users, the public or to Boschung and/or as required or permitted by law.

Boschung and its partners use cookies or similar technologies to analyze trends, administer our digital channels, track users’ movements around the Websites, and to gather demographic information about our user base as a whole. We use cookies or similar technologies to improve our Websites and Services, to understand the usage of our Websites and Services, to advertise to you, to provide you with personalized content, to improve our user experience and for security reasons.

We take the responsibility of keeping your personal information and data in safety seriously. Through our physical and digital security, we offer a high level of security. All data and personal information are hosted in high-performing server rooms. This solution offers a professional support, supervised smart monitoring systems, maintenances, regular updates and security.

Our Services are not intended for and may not be used by individuals under the age of 13 (or under a higher age according to the laws of their residence). Boschung does not knowingly collect personal data from them or allow them to register. If it comes to our attention that we have collected personal data from one of them, we may delete this information without notice. If you have reason to believe that this has occurred, please contact customer support.

We can make changes to this Privacy Policy from time to time. We may identify the changes we have made on this page. In circumstances where a change will materially change the way in which we collect or use your personal information or data, we may send a notice of this change to all of our account holders.

We provide opt-out options in all direct marketing emails. Finally, if you do not wish to see personalized marketing content on the web related to our Services, you can clear the cookies in your browser settings. Should you choose to opt-out, we will not be able to communicate with you for updates to the Services, new Services, or provide you with tailored content addressing your challenges.

As mentioned above, all data are controlled directly by the Customer and its administrators.

The controller of the personal information is Boschung.

Where you hold an account with our Services, you are entitled to a copy or the removal of all personal information and data which we hold in relation to you. You also may be entitled to request that we restrict how we use your data or object to some aspect of our treatment of your data. You can access the majority of your data and personal information in your own account when you log in. Please remember that you can export some data and information through our tools.

When you have visited our Websites and you want to exercise any of the above rights please contact us. Please remember that we do not have any personal information or data on you until you willingly submit them. So if your request is for the right to be forgotten as it relates only to our use of cookies you can achieve this by clearing the cookies in your browser settings.
